Opt-Out Loss/Accidental Damage Waiver

NOTICE FOR RENTAL OF TRENCH PLATE RENTAL CO (TPR) / TPR TRAFFIC SOLUTIONS (TPRTS) RENTAL EQUIPMENT. THIS AGREMENT OFFERS, FOR AN ADDITIONAL CHARGE, A LOSS / ACCIDENTAL DAMAGE WAIVER TO LIMIT YOUR FINANCIAL REPONSIBILITY FOR LOSS / DAMAGE TO THE RENTAL EQUIPMENT. BEFORE DECIDING WHETHER TO PURCHASE THE LOSS / ACCIDENTAL DAMAGE WAIVER, YOU MAY WISH TO DETERMINE WHETHER YOUR OWN INSURANCE AFFORDS YOU COVERAGE FOR DAMAGE TO THE RENTAL EQUIPMENT AND THE AMOUNT OF THE DEDUCTABLE UNDER YOUR OWN INSURANCE COVERAGE. THE LOSS / DAMAGE WAIVER MUST APPEAR ON THE RENTAL CONTRACT AT TIME OF DELIVERY FOR THIS LOSS / DAMAGE WAIVER TO BE CONSIDERED ACCEPTED.
THE ACCIDENTAL DAMAGE WAIVER IS NOT INSURANCE. Upon accepting the Loss / Accidental Damage Waiver Plan, Renter agrees to pay a charge of 14% of the rental charges on Equipment covered by the Loss / Accidental Damage Waiver. In return, TPR / TPRTS agrees to waive certain claims for Loss or accidental damage to covered Equipment occurring during normal and careful use. Renter remains liable for all other damages under the Terms and Conditions of the TPR / TPRTS Rental Contract Terms and Conditions, which are considered to be included as part of this agreement.
Theft Protection: For equipment that has been stolen the customer is responsible for 10% of the manufacturer’s List price, up to a maximum of $500 per item. In the case of theft of the equipment, your responsibility is limited when you have paid for the Loss / Accidental Damage Waiver and comply with the rental contract, including filing a police report of the theft within 48 hours of discovery of the theft. If the equipment is recovered at a later date, TPR / TPRTS retains ownership.
Accidental Damage Protection: For Accidentally Damaged Equipment the cost of repairs (Incidental and Accidental) the customer is not responsible for repairs.
For all other damage and loss due to negligence and use inconsistent with the manufacturer’s recommendations or the terms and conditions of the TPR / TPRTS rental contract Customer is responsible for all losses and damages.
Renter is responsible for the care and safekeeping of the rental equipment from the time of delivery until the time of return to TPR / TPRTS. Renter agrees that Renter will use its best efforts to safeguard the Equipment from loss, damage or theft at any and all times while the rental equipment is in their possession, until the rental equipment is returned to TPR / TPRTS.
